1. SCOPE OF APPLICATION

For all orders via our online shop the following terms and conditions apply.

2. CONTRACTING PARTY, CONCLUSION OF CONTRACT

The contract partner for customers is Cirak Electronics UG. The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalogue. You can place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained in the order process. By clicking on the order button, you place a binding order for the goods contained in the shopping basket. The confirmation of receipt of your order is sent by e-mail immediately after sending the order. When the contract with us is concluded depends on the method of payment you have chosen.

3. CONTRACT LANGUAGE, CONTRACT TEXT STORAGE

The languages available for the conclusion of the contract are German and English. The text of the contract is not stored by us.

4. TERMS OF DELIVERY

Shipping costs are added to the stated product prices. You can find out more about the amount of the shipping costs in the offers. We only deliver by mail order. Unfortunately it is not possible to collect the goods yourself. We do not deliver to packing stations. A delivery of tobacco products will only be made domestically (Germany). Shipping abroad is not possible.

5. PAYMENT

In our shop you can choose between the following payment methods:

PayPal
During the ordering process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or first register, authenticate with your access data and confirm the payment order to us. After placing the order in the shop, we will ask PayPal to initiate the payment transaction.
The payment transaction will be carried out automatically by PayPal immediately afterwards. You will receive further instructions during the ordering process.

Within the framework of the payment service PayPal Plus we offer you various payment methods as PayPal Services. You will be forwarded to the website of the online provider PayPal. There you can enter your payment data, confirm the use of your data by PayPal and the payment instruction to PayPal.

If you have chosen the payment method PayPal, you must be registered there or register first in order to be able to pay the invoice amount and legitimise yourself with your access data. The payment transaction is automatically carried out by PayPal immediately after confirmation of the payment order. You will receive further instructions during the ordering process.

If you have chosen the credit card payment method, you do not need to be registered with PayPal to be able to pay the invoice amount. The payment transaction will be carried out immediately after confirmation of the payment instruction and after your legitimation as the

rightful cardholder by your credit card company at the request of PayPal and your card will be charged. You will receive further instructions during the ordering process.

If you have chosen the payment method direct debit, you do not need to be registered with PayPal to be able to pay the invoice amount. With confirmation of the payment instruction you give PayPal a direct debit mandate. PayPal will inform you about the date of the debit (so-called prenotification). By submitting the direct debit mandate immediately after confirmation of the payment instruction, PayPal requests its bank to initiate the payment transaction. The payment transaction is executed and your account is debited. You will receive further instructions during the ordering process.

Klarna invoice
When purchasing on account via Klarna, you always have a payment period of 14 days. The complete terms and conditions for purchase on account for deliveries can be found here:

Immediately by Klarna
If you pay with Sofort by Klarna, you will usually receive goods in stock quickly and

Klarna installment purchase
The Klarna installment purchase is only offered for Germany. When buying in installments

6. TRANSPORT DAMAGES

If goods are delivered with obvious transport damages, please complain about such defects to the deliverer as soon as possible and contact us immediately. Failure to make a complaint or contact us will not have any consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to be able to assert our own claims against the carrier or the transport insurance company.

7. WARRANTY AND GUARANTEES

Unless expressly agreed otherwise below, the statutory liability for defects shall apply. The limitation period for claims for defects is one year from delivery of the goods in the case of used goods. The above limitations and shortening of the period do not apply to claims based on damage caused by us, our legal representatives or vicarious agents:
in case of injury to life, body or health,
in the event of intentional or grossly negligent breach of duty and fraudulent intent,

in the event of breach of material contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)
within the framework of a guarantee promise, if agreed or
insofar as the scope of application of the Product Liability Act is opened up.

8. LIABILITY

We always have unlimited liability for claims based on damage caused by us, our legal representatives or vicarious agents:
in case of injury to life, body or health,
in case of intentional or grossly negligent breach of duty, in the case of guarantee promises, if agreed, or
insofar as the scope of application of the Product Liability Act is opened up.
In the event of a breach of material contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

9. SETTLEMENT OF DISPUTES

The European Commission provides an Online Dispute Resolution (OS) platform, which you can find at https://ec.europa.eu/consumers/odr/. Consumers have the possibility to use this platform to settle their disputes.

In order to settle disputes arising from a contractual relationship with a consumer or whether such a contractual relationship exists at all, we are obliged to participate in dispute resolution proceedings before a consumer arbitration board.

10. PROTECTION OF MINORS

If your order includes goods whose sale is subject to age restrictions, we will ensure that the customer has reached the required minimum age by using a reliable procedure involving a personal identity and age check. The deliverer only hands over the goods after the age check has been carried out and only to the orderer personally.

11. DELIVERY TIMES

The delivery of the goods in the inland (Germany) takes place within 1 – 3 days, after conclusion of the contract .With agreed upon pre-payment the supply takes place after the time of your payment instruction. Please note that there is no delivery on Sundays and public holidays.

12. SUBSCRIPTION

By registering for the subscription, personal data is collected. These are expressly recorded as voluntary data. Without exception, the data will not be passed on to third parties.

Declaration of consent

The participant gives his/her consent for Cirak Electronics UG to store and use this data for advertising and market research purposes (primarily for the purpose of sending information by post, e-mail or SMS). The participant may revoke his/her consent at any time by written declaration.

This sending of information may be based on the individual interests of the participant. The alignment with individual interests is based on the data resulting from the participant’s use of the website.

Cancellation (unsubscribing from the newsletter)

Unsubscribing from the newsletter is possible at any time free of charge. Subscribers who no longer wish to receive the newsletter or promotional emails click on a link called “Unsubscribe from newsletter”, which is included in all emails sent.
